STEPS TO TERMINATE LEASE

GIVING TERMINATION NOTICE

 

When Tenant determines they will be terminating their lease, it is helpful when Tenant advises Landlord as soon as possible, even if prior to 60 day lease requirement, since Landlord receives inquiries periodically.  A phone call to Landlord is a friendly way to initially communicate the Tenant's intent to terminate lease, however the binding termination notice must be  in written form with Tenant's signature.  Notice can be delivered in person, faxed to 302-947-1762, emailed as an attachment, or sent by mail to address in lease.                          

 

After one year minimum lease term obligation, Tenant's lease automatically continues on a month-to-month basis requiring minimum sixty (60) days written notice prior to expiration of the term, effective on the first (1st) day of the month following the day of actual notice.  For example, if Tenant provides 60 day notice on February 2, the lease termination date would be on April 30; Tenant would be responsible for rent through April 30.  Security deposit is NOT for use by Tenant as the last month's rent.  

 

Tenant can communicate to Landlord in their Termination Letter that they are willing to vacate on an earlier date then their termination date, if  xx days notice by Landlord. Landlord can offer this move-in date option to prospective tenants.  If new Tenant moves into rental before current Tenant's lease expiration date, the new Tenant is obligated to pay the rent effective their move in date and the old Tenant is entitled for a refund of rents paid any overlap period.

 

 

LANDLORD SHOWING HOME TO PROSPECTIVE TENANTS

 

Landlord contacts Tenant in accordance to Lease Addendum--Right of Access in Lease. Landlord discusses with Tenant  scheduling preferences for rental showings to prospective tenants.  Landlord tries to honor requests.  Landlord has prospective tenants answer an informal pre-showing questionnaire so they meet minimum requirements and house meets their needs before scheduling a showing..

 

It is expected that Tenant's house may not be in Tenant's desirable showing condition during the moving process or when a showing scheduled with short notice. It is helpful to reflect that the primary focus of prospective tenants is to evaluate the floorplan and general condition of home.   Landlord appreciates Tenant's understanding and accommodation since each showing is considered an opportunity. 

 

CLEANING

 

Tenant should return property to Landlord in the same clean condtion as provided to Tenant at beginning of lease.  If desired, Landlord can hire on Tenant's behalf someone to clean house after they vacate and Landlord will coordinate and supervise.  Landlord has cleaning persons that are a good value, hardworking, trustworthy, thorough and diligent and have cleaned Landlord's rentals previously. Although Landlord cannot provide a labor cost quote, labor usually between $150-$250 depending on size of house and extent of cleaning required. Many Tenants choose this option considering all the other responsibilities when moving.

 

Carpet drycleaning, although paid by Tenant, usually scheduled by Landlord to properly time when property vacant, painting and, if pets, prior to precautionary flea spraying.  Carpet drycleaning only scheduled with Masten's as indicated in lease; Masten's cleaning system keeps moisture out of carpet and pad to prevent mold issues for allergy tenants.

 

During final week, self-clean oven and clean under appliances.  Glass shower doors and tubs may have soap buildup and hard water stains; cleaning them can take multiple efforts, maybe hours; click on "Cleaning Expectations..." document below for product suggestions. Replace broken blinds--see your home's Maintenance Supply List under Maintenance Tab (insure correct model and color).  Window screen repairs can be done inexpensively at Yoder's Glass 302.492.1810.  Best resource for cleaning products and suggestions is the  "Cleaning Expectations..." document below.

WALK THROUGH AND TURNING IN KEYS

 

Once Tenant has moved all personal belongings out of the home, Tenant no longer occupying home, and Tenant completed the cleaning they will be doing, Tenant can contact Landlord for walk through.  Landlord and Tenant will review the rental unit and premises for its general condition.  The keys can be given to Landlord.  There could be damages discovered after the walk through but during the turnover process, when carpet cleaning, painting and balance of housecleaning is completed, that are Tenant's responsibility.   If material damages discovered after walk through, the Landlord contacts Tenant so Tenant can view damages prior to these damages being repaired; if Tenant not available, Landlord will try to take pictures.

 

If Tenant completes walk through and turns in keys to Landlord, prior to lease termination date, the Tenant is responsible for the utilities and rent through termination date unless a new tenant moves in rental or Landlord stipulates in writing otherwise.  

 

 

 

 

 

 

SECURITY or PET DEPOSIT 

 

Prior to Tenant vacating the property, the Tenant must provide Landlord a forwarding address, in writing.  Within twenty (20) days of the termination of the rental agreement, the Landlord must provide the Tenant with an itemized listing of any damages to the premises and the cost of repairs, and must return any money remaining from the security or pet deposit to the Tenant. Landlord may recover for damages greater than the amount of deposit.
